Guidelines for Formation of State Chapters of AOMSI

 

I. General Rules

a) The AOMSI constitution encourages the formation of state branches.

b) Any State or region approved by the EC may start a branch if they have a minimum of 20 Annual or Life members.

c) The members may congregates at a place and decide to form a branch and request permission of the National EC by a letter of intent with the signatures of all members. The EC shall deliberate and if approved communicate the matter to the appellants.

d) The EC / AGM may officially order for the charter for the formation of a state / regional branch and officially declare it a state / regional branch. A file for the same will be maintained at the secretariat.

e) The EC has the right to with draw recognition and charter by a 2/3 majority. This will not affect the membership status of the individual members of AOMSI.

f) A state / regional branch may be derecognized if found to be acting against the interest of the AOMSI or if 2/3rd of the members of a state branch request for a derecognition.

g) Defense Wing

Officers serving in the Army or any of its wings under the Army Dental Corps may if they wish form a separate branch which may be considered a state / regional branch.

All the rules shall apply to the Defense Branch except the minimum number of members.

II. Rules and Regulation

a) The constitution of the State / Regional branch will be subservient to the constitution of the AOMSI and the state branch shall be called the AOMSI ‘State’ Branch and no other name eg AOMSI Karnataka State AOMSI Branch and shall exhibit the logo of the AOMSI and no other logo.

A copy of the constitution shall be sent to the EC for ratification within 6 months of formation of the state branch.

In case of any conflict of interests in the constitution, the constitution of AOMSI shall prevail.

b) The list of members in each state shall be sent to the secretariat on before the 31st of January each year.

c) In case of conflicts within the branch a member or members can appeal to the National Executive by placing its complaint to the Hon. General Secretary of the AOMSI.

d) In case of dispute or conflict the decision of the National EC shall be final. Such arbitration shall be governed by the provisions of the Indian Arbitration Act.

e) The State / Regional branches may raise their own finances and will not be funded through the national AOMSI.

The regional life and annual fees can be fixed by the state branch and the matter communicated to the AOMSI.

f) Neither the AOMSI national body nor the state / regional body shall be liable for the debts or liabilities of the other party.

g) The state / regional branches may conduct their own annual meeting, hold election and nominate office members.

h) The National President and Hon. Gen. Secretary shall be ex-officio members of all state / regional Executives and shall be invited to attend all meetings and functions at their own expense.

i) If a state / regional branch wants to close down its branch, the matters may be communicated to the head office with the signatures of at least 2/3rd of its members.

All accounts, cash, fixed deposits, securities and other instruments may be transferred to the head office and kept in trust for disbursements as decided by the national EC.

j) As there is no sharing of funds between state and National bodies the states are free to utilize their funds in any appropriate manner without conflicting with the interests of the AOMSI national body.

k) The AOMSI state branch is to be established as per the preamble and objectives of the AOMSI and is therefore to be bound by the registration rules of the parent body. The State AOMSI cannot be separately registered in any other state or register office.
